Health Practitioners Disciplinary Tribunal (HPDT)


Relevant Legislation
The Health Practitioners Disciplinary Tribunal (HPDT) is established under section 84 of the Health Practitioners Competence Assurance Act 2003.

Functions
The functions of the HPDT are to:
  • to hear and determine charges brought against a health practitioner by the Director of Proceedings or a professional conduct committee
  • to exercise and perform any other functions, powers and duties that are conferred or imposed on it by or under the HPCA, or any other enactment.

Composition
The HPDT consists of:
  • a chairpersons and three deputy chairpersons, each of whom must be a barrister or solicitor of the High Court of not less than seven years' practice, whether or not he or she holds or has held judicial office; and
  • a panel of-
    • practitioners of each profession, each of whom must hold a current practising certificate; and
    • laypersons.

For the purpose of each hearing, the Tribunal consists of:
  • the chairperson of the Tribunal or a deputy chairperson of the Tribunal; and
  • four persons selected by the chairperson or the deputy chairperson from the panel, of whom-
    • three must be professional peers of the health practitioner who is the subject of the hearing; and
    • one must be a layperson.
