Note: the Ministry is able to offer general advice about the requirements of the 2003 amendments to the Smoke-free Environments Act 1990 (the Act). However, because the Ministry is the lead enforcement agency, in instances where breaches of the Act are alleged or where prosecutions may be considered, it would be inappropriate for the Ministry to provide specific legal interpretations relating to particular situations. Anyone wanting specific legal advice or legal interpretations of the Act should contact a lawyer or legal expert.
